Terms of Service

These Terms of Service (the "Terms") govern your access to and use of aletheiatalent.group and every page, archive, screening, form and service offered through it (together, the "Site"), operated by The Aletheia Talent Group, LLC, a New York limited liability company ("ATG", "we", "us" or "our"). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

1. Who may use the Site

You must be at least 18 years old, or the age of majority where you live, to use the Site. If you use the Site on behalf of a company, foundation, production or other organization, you confirm that you are authorized to accept these Terms for it, and "you" includes that organization.

2. Our work and our principals

The Site describes the productions ATG creates and the principals, companies and artists it represents. Descriptions of past productions, credits and engagements are offered as a record of our work and are not an offer, a guarantee of availability or a promise of any result. Any engagement of ATG or of a principal is made only by a separate written agreement signed by an authorized representative of ATG. Nothing on the Site creates an agency, partnership, employment or representation relationship between you and ATG or any principal.

3. Archives, screenings and private links

Parts of the Site, including the archives, are available only by invitation, passphrase or private link. Each passphrase and link is issued to a named recipient for that recipient's own viewing. You agree to keep it confidential, not to share or forward it, and not to attempt to reach any film, record or page you were not invited to view. Films, recordings and materials in the archives are shown for review only. You may not download, record, capture, copy, screen publicly, broadcast, distribute or otherwise reproduce them, in whole or in part, without our prior written consent. We may withdraw any passphrase or link, and end any access, at any time and without notice.

4. Ownership

The Site and everything on it, including text, the ATG name and monogram, designs, photographs, films, recordings, artwork, logos and the selection and arrangement of all of it, belong to ATG, its principals or their licensors, and are protected by copyright, trademark and other laws. Names, likenesses and works of principals, artists and partners appear with their permission and remain theirs. These Terms give you a limited, personal, revocable, non-transferable right to view the Site for your own non-commercial use. No other right or license is granted.

5. Acceptable use

You agree not to: copy, scrape, harvest or mirror the Site or its contents by automated or manual means; use any name, likeness or work shown on the Site for any purpose without the written consent of its owner; use the Site or its contents to train, test or improve any artificial intelligence or machine learning system; interfere with the security or operation of the Site, or attempt to bypass any passphrase, access control or rate limit; impersonate any person or misstate your affiliation; or use the Site in any way that breaks the law or infringes the rights of others.

6. Briefs, inquiries and submissions

When you send us a brief or inquiry through the Site, you confirm that the information you provide is accurate and that you are entitled to share it. We read every brief and answer in writing at our discretion. We do not accept unsolicited scripts, treatments, music, artwork or other creative materials. If you send them anyway, we have no obligation of confidentiality or compensation regarding them, and our own development of similar ideas does not give rise to any claim. Nothing you send creates any obligation for ATG until both parties sign a written agreement.

7. Confidential occasions

Some of our work is produced for clients who require discretion. Such engagements are governed by their own written agreements, and nothing on the Site identifies or describes them. Where those agreements and these Terms differ, the written agreement controls.

8. Events and tickets

Events, performances and ticketed occasions produced or presented by ATG may carry their own terms, which are provided at the time of booking or purchase and apply to those occasions in addition to these Terms.

9. Privacy

Our Privacy Policy explains how we collect and use personal information through the Site. It forms part of these Terms. You can read it at aletheiatalent.group/privacy.

10. Links to other sites

The Site may link to sites and services we do not operate. We are not responsible for their content, terms or practices, and a link is not an endorsement.

11. Disclaimers

The Site is provided "as is" and "as available". To the fullest extent the law allows, ATG disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement, and makes no promise that the Site will be uninterrupted, secure or free of errors.

12. Limitation of liability

To the fullest extent the law allows, ATG and its members, managers, principals, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to the Site or these Terms. Our total liability for any claim relating to the Site will not exceed one hundred US dollars (US$100).

13. Indemnity

You agree to defend, indemnify and hold harmless ATG and its members, managers, principals, employees and agents from any claim, loss or expense, including reasonable attorneys' fees, arising out of your breach of these Terms or your misuse of the Site.

14. Governing law and venue

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. Any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to their jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. The date at the top shows when they last changed. Your continued use of the Site after a change means you accept the updated Terms.

16. General

If any part of these Terms is held unenforceable, the rest remains in effect. Our failure to enforce any right is not a waiver of it. You may not assign these Terms without our written consent; we may assign them in connection with a reorganization or sale of our business. These Terms, together with the Privacy Policy and any written agreement between you and ATG, are the entire agreement between you and us about the Site.
